Updated Privacy Policy Statement / Personal Information Collection Statement 

This Privacy Policy and Information Collection Statement outlines how the Private Wealth Management Association (PWMA) in Hong Kong collects, uses, and protects your personal information in compliance with the Personal Data (Privacy) Ordinance (PDPO) of the Hong Kong Special Administrative Region.  

The Statement is intended to notify you what personal data is collected and why, how it will be used, how long we keep the data, what our security measures are and how access requests are to be addressed.  

“Personal Data” means any personally identifying information as more particularly defined in the PDPO. 

The PWMA is committed to complying with the requirements of the PDPO and ensures compliance by our staff with the strictest standards of security and confidentiality. 

What PWMA Collects: 

• Personal Contact Information, such as name, telephone number, email address, mailing address and other personally identifiable information such as your ID card or bank account details;  

• Work Related Information, such as your job title, name of your company and work history (CV); and 

• Access Information and Cookies when you visit the PWMA website but do not submit any personal data online.  

When PWMA Collects It: 

• When you provide such data to us directly in person or by telephone, mail or email; 

• When you submit such data to us on the PWMA website (e.g. form/application submissions and event registration); 

• When you navigate through the PWMA website; and 

• When we are required to do so by law or regulation. 

When collecting your Personal Data, we will inform you whether it is obligatory or voluntary for you to provide such Personal Data to us. While the supply of your Personal Data is voluntary, if you choose not to provide your Personal Data to us, we may not be able to provide you with the information or services that you require. 

What PWMA Does with It: 

• To process your membership application or renewal; 

• To process your accreditation application or renewal; 

• To process apprenticeship scheme applications, select candidates and execute the apprenticeship program; 

• To register you for events and verify your attendance; 

• For direct marketing purposes to send you information, newsletters and other materials about us, our business partners, and event invitations both in print and in electronic form (if you consider this use of your Personal Data unacceptable, please contact us with your objection using the contact details below);  

• To collate data and prepare reports on our operations; 

• To process billing and payments; 

• To communicate with you and assist with your queries regarding your membership, accreditation, apprenticeship scheme and registered events;  

• To collate broad demographic data and produce aggregated information about the number and types of visitors to our site; and 

• To make sure disclosures as required by applicable laws and regulations. 

When collecting your Personal Data, we will inform you of the purpose for which Personal Data will be used following collection. In instances where data is collected for Direct Marketing purposes, we will ensure that we obtain your consent or an indication of no objection before using your Personal Data for this purpose. 

We will process your Personal Data fairly and only for those purposes we have told you, for the purposes permitted by you or as permitted by applicable laws or regulations. In addition, you may object to certain types of processing as expressly permitted by applicable laws or regulations. 

If you provide us with Personal Data about another person, you confirm that you have obtained their consent to the processing and transferring of their Personal Data to us and that you have informed them of our identity and the purposes for which their Personal Data will be processed and used by us. 

How Long Does PWMA Keep It: 

PWMA shall retain your personal data for as long as it is necessary for the purposes set out above. We will destroy any of your Personal Data that we no longer require as soon as practicable. 

How Does PWMA Secure It: 

PWMA takes appropriate measures to ensure that the Personal Data disclosed to us is kept secure, accurate and up to date. We maintain this security by implementing appropriate physical, electronic and managerial means to secure your personal data. 

While we take all reasonable measures to protect your Personal Data and to limit the use of it (as described in this Policy), we cannot guarantee that it will remain constantly secure. There is always a possibility that your Personal Data could be lost due to technical problems or stolen from our databases by malicious computer users. We will not be held responsible for any such loss or theft. 

How Can You Access and Amend It: 

You are entitled to ask for a copy of the Personal Data we hold about you and to have any inaccuracies in your Personal Data corrected. We reserve the right to charge a reasonable fee for complying with your data access request. Our contact details are provided below. 

Transfer or Disclosure of It: 

PWMA will never sell your Personal Data to any third party. 

PWMA will not disclose your data to other third parties except for the specific classes of data transferees listed below. Personal Data collected by us will be kept confidential, but where disclosure is necessary for us to (a) comply with legal or regulatory obligations or requirements, or (b) provide services to you, or (c) carry out the original purposes, or a directly related purpose specified above, for which the Personal Data was collected, those Personal Data may be provided to the following parties (whether within or outside Hong Kong): 

• Staff or other members of PWMA as well as our business partners such as other associations and universities; 

• Competent court of law, law enforcement agency, office of the communications authority or other governmental, statutory or regulatory authority, institution or organization; and 

• Any person you have authorized to interact with us on your behalf. 

Some of the persons to whom we disclose Personal data may be situated outside of Hong Kong. 

PWMA stores the collected Personal Data in data centers of third-party data storage provider(s) within or outside of Hong Kong. 

Translation 

This Privacy Policy has been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
